In the context of income tax, this includes both advance payments made by entrepreneurs and annual tax returns.
One exception to this rule applies to people taxed under the tax card system. In such a situation, the competent tax office is determined according to the place where the organized business establishment indicated in the CEIDG-1 application is located.
Individual taxpayer – which tax office should you indicate?
In this case, the competent tax office is determined by the place of residence, understood as the place that constitutes the so-called center of vital interests of a given person. It does not therefore have to be the registered address, but the actual place of residence where the taxpayer stays permanently.
For tax purposes, it is assumed that each person has only one place of residence. If a taxpayer stays in several places during the year, they should choose one that will serve as their settlement center.
In the case of spouses who have joint marital property but live in different places, the competent tax office will be the one located in the area where one of them lives. If, however, the spouses settle their taxes separately, each of them must submit their tax return to the office competent for them.
Competent tax office for a sole proprietorship
In the case of entrepreneurs running a sole proprietorship, unlike legal persons where the registered office address is important, the key factor when choosing the competent tax office remains the place of residence. The business registration address entered in CEIDG matters only for registration and contact purposes and does not affect matters related to the tax office.

A taxpayer who does not have a registered address in Poland should handle fiscal matters at the tax office competent for their place of stay. This mainly applies to foreigners, for whom the appropriate office is the one competent in matters concerning foreign taxpayers.

It is worth emphasizing once again that, in the case of PIT settlements, the registered address is irrelevant. There is therefore no requirement for the address of the competent tax office to be connected with the taxpayer’s registered address.

Tax offices in Poland have a specific territorial scope assigned to them. On the official website of the Ministry of Finance, you can find a tool for quickly searching for the competent tax office for a given taxpayer. To do this, you only need to enter the postal code together with the town or city, and the system will provide the relevant information, including the office address and number.
How can you check the competent tax office?
Each tax office provides information about its territorial scope on its website. Taxpayers who receive income through a payer can also determine the competent tax office using information from forms such as PIT-11, PIT-40A/PIT-11A, or PIT-8C.
What should you do if you change your place of residence or company registered office?
If a taxpayer changes their place of residence during the tax year, the competent tax office also changes. In that case, the settlement should be made with the tax office competent for the taxpayer as of the last day of the tax year to which the declaration relates.
Importantly, people who change their residential address are required to inform the tax office about this fact within 7 days of the change.
